Question
Will the Minister confirm that no money from the 21st century schools budget will be earmarked or set aside for any scheme that proposes to build on land protected by charitable covenant that prohibits such building?

It is the responsibility of the relevant local authority or college to ensure that all legal obligations including those linked with land, are settled with all relevant stakeholders involved.
Any funding through the Sustainable Communities for Learning Programme is subject to a robust business case assessment process which includes ensuring that all statutory and legal requirements are satisfactorily completed.
