Question
Will the Minister make a statement on the fact that developments can be issued with a certificate of final completion by an independent building inspector despite no environmental permit being in place for sewage discharge?
Answer
Answered by Minister for Climate Change
Many different consents, permits and approvals may be required when undertaking building work. Each consenting regime will have its own purpose, consenting process and system of enforcement and it is not for one regime to enforce the requirements of another.
Building control bodies check compliance with the requirements of the Building Regulations, however, Natural Resources Wales enforce the requirements of The Environmental Permitting (England and Wales) Regulations 2016.
Building regulations guidance (approved document H) does advise that those seeking Building Regulations approval for non-mains drainage should determine whether a consent to discharge is required before an application is made for Building Regulations approval, as it may have a direct bearing on the type of drainage system that may be installed.
