Written question WQ86760

I am very conscious of the effect fireworks can have on wildlife, pets and farmed animals. For this reason, my officials worked in collaboration with officials in the Department of Business, Energy and Industrial Strategy (BEIS) Office for Product Safety and Standards on commitments made in the UK Government response to the House of Commons Petitions Committee. Bilingual awareness-raising publicity materials were circulated promoting the responsible use of fireworks to all Welsh Local Authorities, for use on their websites and social media. In particular, one document was produced which was specifically targeted at keeping nearby animals safe during any use of fireworks and officials will continue to ensure messaging is communicated throughout Wales.

There are restrictions on the sale, possession and use of fireworks. The Fireworks Act 2003 grants the UK Government powers to control the use of fireworks in England and Wales, in order to limit the risk of fireworks causing death, injury or distress to persons or animals, or damage to property. Legislation, as it stands, aims to strike a balance between many people’s enjoyment of both the sights and the sounds of traditional firework displays and the dislike of others for those sensory effects. This balance includes, for example, a consideration for minimising annoyance to individuals, while allowing cultural and religious festivals to be celebrated.

In the absence of a clear commitment by the UK Government to tighten regulations in England and Wales, we have asked the UK Government to consider the possibility of transferring relevant powers to Welsh Ministers.

The Welsh Government will continue to work with key stakeholders, including Local Authorities and the other Administrations to ensure any changes in this area will have a lasting impact on animal welfare standards in Wales.
