Summary
The committee began by appointing a temporary Chair, because the Chair's position had become vacant. It then heard Senedd lawyers report technical points on two new instruments, with Welsh Government responses awaited. It also noted Welsh Government responses on two sets of regulations it had considered before, and then went into private session.
Themes
- A vacant Chair and a temporary appointment
- Technical reporting points awaiting Welsh Government explanation
- Differences between the Welsh and English texts
- Clarity in drafting and in explanatory memoranda
1. Motion to elect a temporary Chair under Standing Order 17.22 for this meeting
The committee dealt with the vacancy in the Chair and the choice of a temporary Chair for the meeting.
- Sarah Sargent said the Chair's position became vacant under Standing Order 17.2P(v) when Sarah Cooper-Lesadd MS left the Reform UK group and joined the Plaid Cymru group.
- Peter Fox (Welsh Conservatives) nominated Peredur Owen Griffiths. Sarah Sargent said there were no other nominations and no objections, and invited him to take the chair.
4. Instruments that raise issues to be reported to the Senedd under Standing Order 21.2 or 21.3
Senedd lawyers reported one technical reporting point on each of two new instruments, and the committee is waiting for Welsh Government responses.
- Peredur Owen Griffiths (Plaid Cymru) introduced the Child Minding and Day Care Exceptions (Revocation and Transitional Provision) (Wales) (Amendment) Order 2026, which revokes and replaces the 2010 Order and comes into force on 1 April 2027.
- Kate Rabaiotti said the point on the Order is reported under Standing Order 21.2(v). It notes an inconsistency between the preamble and the explanatory memorandum about the powers relied on, and Welsh Government has been asked to clarify them.
- Kate Rabaiotti said the point on the Local Authorities (Annual Sufficiency Plans) (Wales) Regulations 2026 asks Welsh Government to explain an apparent inconsistency in cross-referencing in the definition of 'annual sufficiency plan' in regulation 2(1).
- The Chair asked for comments on both instruments and none were raised.
5. Instruments that raise issues to be reported to the Senedd under Standing Order 21.2 or 21.3—previously considered
The committee considered Welsh Government responses on two sets of regulations it had first looked at on 14 September. Senedd lawyers raised a general point about drafting and explanatory memoranda.
- On the School Funding, Budget Statements and Outturn Statements (No. 2) (Wales) Regulations 2026, Kate Rabaiotti said that of 12 technical points, two Welsh/English inconsistencies will be fixed by correction slip and six when the regulations are next amended. Of the other four points, one needs correction at the next amendment and Welsh Government answered three.
- Kate Rabaiotti said some responses state that the approach reflects established drafting. She suggested Members may wish to note that established approaches can still be improved, particularly where the committee has identified unclear drafting. Senedd Legal Services had no further comments.
- On the Building etc. (Amendment) (No. 2) (Wales) Regulations 2026, Kate Rabaiotti said Welsh Government explained seven of nine technical points. It confirmed the English text is correct in both Welsh/English differences, to be fixed by correction slip.
- Kate Rabaiotti said Welsh Government withdrew and replaced the explanatory memorandum. It said it did not consider that the other points raised by the sixth Senedd committee needed correcting by amendment.
- Kate Rabaiotti suggested explanatory memoranda should state clearly which committee reporting points are addressed and which are not, and that Members may wish to pursue this with the Counsel General. Peredur Owen Griffiths (Plaid Cymru) said the committee would keep track of the point.
