Is the Minister content that due process has been followed regarding the incinerator development on Barry Docks?

Atebwyd gan Minister for Climate Change
The construction and operation of an energy from waste facility requires a number of different permissions and permits. Consents required by the facility at David Davies Road, Barry Docks have included planning permission from Vale of Glamorgan Council as local planning authority and an environmental permit from Natural Resources Wales.
Of the planning applications made in respect of this site, there is one application where due process was not followed as referred to in my letter to the Docks Incinerator Action Group of 29 July 2021. My work is ongoing to consider the duty of sincere co-operation, informed by the public consultation held at the end of 2021, which I hope to determine soon.
I note the Vale of Glamorgan Council is of the opinion the construction of the facility did not follow due process as it was not in accordance with a planning permission and has issued an enforcement notice in respect of the development. The developers’ appeal against that enforcement notice, is being examined by a planning inspector. The inspector’s report will help me determine the appeal, and until then I cannot comment further.
It is a matter for Natural Resources Wales to satisfy itself whether procedures relating to environmental permitting have been followed correctly both in respect of the determination of applications for permits and implementation of those permits.
