Will the Cabinet Secretary confirm which clause or clauses in the Developer Remediation Contract enables the Welsh Government or others to take a developer to court in order to enforce the contract, and under which circumstances will the Government do so?
Ateb
Atebwyd gan Cabinet Secretary for Housing and Local Government
Failure by any party to the developer contract, in relation to any clause of the contract that places obligations on them, could amount to a breach of contract.
The legally binding documentation signed by developers includes a requirement for monitoring. Should the agreed terms not be met, the Welsh Government would take steps to address this.
Any enforcement action by the Welsh Ministers would be on a case-by-case basis after consideration of the matter giving rise to the breach.
