Question
What consideration has the Welsh Government given to extending the statutory time limits for appealing planning application decisions and planning enforcement notices?
Answer
Answered by Cabinet Secretary for Economy, Energy and Planning
Where an application is refused, or granted with conditions, an appeal may be submitted for up to 3 months from the date on the planning authority’s decision letter for householder applications, or 6 months for all other planning decisions. Applicants may also appeal on the grounds of non-determination if a planning authority does not determine an application within any statutory timeframe or agreed extended period for up to 6 months from the date the decision was due to be made. For enforcement appeals where the enforcement notice came after an application is refused, any appeal needs to be submitted by whichever of these dates is sooner:
• 28 days from the date on which the enforcement notice is received; or
• 6 months from the date on the application decision letter
Where no planning application has been made and an enforcement notice is served, an appeal must be made before the date the enforcement notice takes effect.
The statutory time limits for planning and enforcement appeals remain appropriate.
