Summary
The Legislation Committee considered a commencement order that raised no reporting issues. It also looked at a letter on the increased cost estimate for the automatic voter registration regulations, and at Welsh Government responses on two other instruments. Members asked where the extra cost would be scrutinised and whether it falls to the Welsh Government budget.
Themes
- Rising cost estimate for automatic voter registration
- Errors in explanatory documents and their correction
- Scrutiny of subordinate legislation
2. Instruments that raise no reporting issues under Standing Order 21.2 or 21.3
The committee considered the Elections and Elected Bodies (Wales) Act 2024 (Amendment to Commencement Order No. 3) Order 2026, which Senedd lawyers found raised no reporting points.
- The Chair, Cristiana Emsley (Reform UK), said the Order commences sections 3 and 4 of the 2024 Act on the day the 2026 automatic voter registration regulations come into force, ahead of the 2027 local government elections.
- Cristiana Emsley said implementation of the 2026 regulations has been delayed by the enhanced 60-day Senedd scrutiny procedure, and that Senedd lawyers identified no reporting points.
4. Instruments that raise issues to be reported to the Senedd under Standing Order 21.2 or 21.3—previously considered
The committee considered a letter on the higher cost estimate for the automatic voter registration regulations. It then noted Welsh Government responses on the Child Minding and Day Care Exceptions Order and the Local Authorities (Annual Sufficiency Plans) Regulations.
- Cristiana Emsley (Reform UK) said the Cabinet Minister's letter raises her estimate of year 1 implementation costs from £2.6 million to £4.4 million, and that the original explanatory memorandum has been withdrawn and replaced.
- Peter Fox (Welsh Conservatives) said the costs had nearly doubled and asked where scrutiny of the costings would take place. Sarah Sargent said the Local Government, Housing and Planning Committee is considering the regulations under the 60-day enhanced procedure.
- Sarah Cooper-Lesadd (Plaid Cymru) asked whether the £4.4 million comes from the Welsh Government budget or the wider UK budget. Kate Rabaiotti thought it was the Welsh Government but said this needed checking, and Sarah Sargent said officials would check.
- On the Child Minding and Day Care Exceptions Order, Kate Rabaiotti said the committee's report found an inconsistency between the Order and the explanatory memorandum on the powers relied on. The Welsh Government confirmed the error was in the memorandum and laid a corrected version, so she said the issue is resolved.
